Policy Statement: Exclusion Criteria for Participation in the BailSafe Program

The BailSafe Program is committed to maintaining a safe and secure environment for all participants and prioritizes the well-being and safety of vulnerable populations, including children and the elderly. To ensure the highest standards of safety and ethical conduct, the following exclusion criteria have been established.

Exclusion Criteria:

1. Sexual Crimes:

   Any individual who has been convicted of sexual crimes, including but not limited to sexual assault, rape, child exploitation, or any other sexually related offenses, will be excluded from participating in the BailSafe Program. This criterion applies to offenses committed against adults or minors.

2. Crimes Against Children:

   Individuals with a history of crimes against children, such as child abuse, child neglect, child endangerment, or any offense involving the exploitation or harm of minors, will be excluded from participation in the BailSafe Program. This criterion also encompasses offenses committed in the presence of children.

3. Elder Abuse:

   Any individual who has been convicted of elder abuse, neglect, financial exploitation, or any other offense involving the mistreatment or harm of elderly individuals will be excluded from participating in the BailSafe Program.

Policy Implementation:

   It is the responsibility of the legal representation, including attorneys, guardians ad litem, or any other authorized individuals, to ensure that prospective participants in the BailSafe Program meet the criteria for participation. Legal representatives must conduct a thorough assessment of the participant's background and criminal history to determine eligibility.

2. Disclosure and Verification:

   Prospective participants are required to disclose any past convictions or charges related to sexual crimes, crimes against children, or elder abuse during the application process. Legal representation must verify the accuracy of this information to the best of their knowledge through appropriate channels, such as criminal record checks or background investigations.

3. Confidentiality and Privacy:

   All information related to criminal history and eligibility for participation in the BailSafe Program will be treated with strict confidentiality and in compliance with applicable privacy laws and regulations. Only authorized personnel involved in the assessment and selection process will have access to this information.

4. Compliance and Consequences:

   Failure to adhere to the exclusion criteria or providing false or misleading information regarding an individual's criminal history may result in immediate exclusion from the BailSafe Program. Legal representation found to have knowingly misrepresented a participant's eligibility may face legal consequences and be subject to disciplinary action

5. Review and Revision:

This exclusion criteria policy will be reviewed periodically to ensure it remains aligned with the best practices, legal requirements, and the evolving needs of the BailSafe Program. Any necessary revisions will be implemented promptly and communicated to all relevant parties.

6. Approval:

This exclusion criteria policy has been approved by BailSafe Australia and is effective from August 2022.
